In accordance with Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, (the complete text of Legislative Decree 21/2014 can be consulted on the  official gazette website), the Customer may withdraw from the Terms and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products. The following conditions apply.

The right of withdrawal for reconsideration, as per EU regulations, is possible, but only for items not made to measure or customized.

Pursuant to Article 59, paragraph 1, letters a) and c) of the Consumer Code, Legislative Decree 206/2005 subsequent amendments and integrations, the right of withdrawal is excluded since the complete execution of the service is immediate and the goods are made and customized based on the User's specifications.

The cost of shipping expenses will be borne by the customer and deducted from the refund amount without any addition at the time of the return request.

Malìa Lab guarantees that the products conform to what is described on the website and in communications with the customer, certifying that such products exhibit the usual qualities and performance of goods and services of the same type and that they are suitable for the use for which they are intended.

In the event that the customer receives a damaged, defective, or non-compliant product, they must write to the address info@malialab.it, attaching a description of the defect and, if possible, photograph(s) of the product detailing the defect. The photographs provided by the customer will be compared and evaluated with those taken by our warehouse before shipment, and the product will be authorized for return if it is determined that the defect is attributable to the company's responsibility (Courier at Malìa Lab's expense). Once returned, the product will be inspected, and a refund of the entire expense will be authorized. In some cases (at the exclusive discretion of Malìa Lab), the defective product may be left with the customer and still reimbursed. If no conformity defect is found, or if the wear conditions of the item make it impossible to determine whether it is a conformity defect, the item will be returned to the sender at no charge.

Returns for custom-made or personalized items are not possible. However, our desire to meet your needs to the best of our ability and our work ethic compel us to accommodate you as much as possible. While you cannot return the item, we can discuss modifications to ensure that you can use the ordered item to the best of its qualities. Naturally, the least we can do is carry out all agreed-upon modifications free of charge. The only thing that will be your responsibility are the shipping expenses (both for return and for sending post-modification).

Important advice: Our customer service and our pattern maker are focused and extremely available to meet your needs. Do not hesitate to ask for video demonstrations of both fabrics and garment fit. It is in our interest to create a garment that is special for you. You can also reach out to us via WhatsApp for any information; we are at your complete disposal, as if you were in the atelier. We understand that distance is a negative factor in online shopping, but we put all our kindness and passion into overcoming this barrier, and availability is our strong point.

• It will not be possible to accept returns for personalized or tailor-made items. (but it is possible to agree on a modification, shipping costs at your expense, free modification)
• The goods must be returned intact, possibly using the packaging in which they were delivered, or one of equal strength, sealed with adhesive tape on all openings.
• A label must be affixed containing the sender's details, the shipping address and the authorization code received. Alternatively, it is possible to hand write the required data on the packaging using a permanent marker.
• The goods must be complete with all their parts and in the original packaging (envelopes, boxes, dustbags and packaging), with the tags still attached.
• All items must be returned together with their original box, where present, which is considered to all intents and purposes an integral part of the product itself and which must not have been damaged and/or altered in any way, and cannot be used as the sole packaging external.
• The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, complements, etc.);
• The shipment, until the certificate of receipt in the warehouse indicated by Malìa Lab, is under the complete responsibility of the customer;
• In the event of damage to the goods during transport, Malìa Lab will promptly notify the Customer, to allow him to file a complaint against the courier he has chosen and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;
• Malìa Lab will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment.
• Malìa Lab will refund the Customer the full amount of the returned items (from which the standard shipping amount of €7 will be deducted, which will be used to pay for the return shipping), within 14 (fourteen) days of receipt of the withdrawal shipment, via the reversal procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In case of payment by bank transfer, the customer must communicate to Malìa Lab the IBAN code to which the refund should be made. In any case, the Customer will not bear any costs as a consequence of said reimbursement. Malia Lab may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back, whichever is earlier.

• In any case, the Customer will lose the right of withdrawal in cases where Malia Lab ascertains that: the returned product and/or its accessories, and/or its packaging are not intact; the product is missing its external packaging and/or the original internal packaging; the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).

• In the event of forfeiture of the right of withdrawal, Malia Lab will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.

• Return shipping is the responsibility of the customer and will be deducted from the refund amount without any addition at the time of the return request.

Our quality fabrics are made in Italy by certified producers present in the ICEA lists, the Institute that checks ethical and environmental certification. The raw material, also certified, comes largely from foreign suppliers for the fibers that are not made in Italy (fewer and fewer fibers are grown and produced on national soil. We are working hard to bring at least some production back to our territory and for the case of broom, directly in Calabria).

However, the weaving and dyeing processes (the most harmful to the environment and the body) are carried out in Italy, this gives us superior control over the materials and superior fabric quality.

Characteristics of the fabric are antistaticity, breathability and silkiness to the touch. Cupro has a consistency and shine very similar to silk, which is why it can be considered "vegan silk".

The fabric is made from regenerated cellulose fiber obtained through artificial cotton linter manufacturing processes. The linters form a short fluff adhering to the seed which is separated with vigorous ginning: it is a very pure cellulose fibre. Cupro has been produced since 1931, solely by Asahi Kasei, starting from cotton linters, a recycled element from the cotton industry. Recovery is one of the credentials to be able to talk about Circular Economy.

Art. 1 – Acceptance of the general conditions of sale and conclusion of the contract

The contract stipulated between Malia lab (hereinafter "Malìa lab") and the Customer (i.e. the individual, natural person, who makes the purchase on the Site, not relating to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by Malìa Lab. In the event of non-acceptance of the order, Malìa Lab will in any case promptly notify the Customer. By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the “Conditions”). These Conditions can be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Art. 2 – Purchase methods

The products offered for sale by Malia Lab are only those present on the Malìa Lab website at the time the Order is placed, as described in the relevant information sheets. In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the Site and view the images). To place an Order, the Customer must complete the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request Malia Lab, where desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree n. 633/1972. The correct receipt of the Order is confirmed by Malia Lab through a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.

Art. 3 – Prices and payment methods

The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions. The following payment methods are available:

Wire transfer

In case of purchase by bank transfer, the bank details for payment will be displayed. Payment by bank transfer entails an additional cost of Euro 2.00 to be paid by the Customer. The goods will be shipped only upon actual receipt of payment in the bank.

Art. 4 – Delivery of products and related costs

The purchased products will be delivered to the address indicated by the Customer in the Order within 72-120 hours, after 24-48-72 hours from the date of registration of the Order by Malia lab, at the cost specifically indicated on the Site before sending of the Order. Malia Lab reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be carried out outside Italian borders, shipping costs and delivery times may vary. With regards to deliveries requested in countries not belonging to the European Union, any import customs costs will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance to verify the costs and any import limits. The delivery times indicated by Malia Lab must be considered purely indicative and a delay compared to them, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or compensation. Upon delivery of the products, the Customer is required to check: that the number of packages delivered corresponds to what is indicated in the transport document. That the packaging is intact, not damaged, wet or otherwise altered, including the closing materials (adhesive tape or metal straps). Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected by placing a specific indication on the delivery document of the product to be returned to the courier. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.

Art. 5 – Right of withdrawal

Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products. To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send Malia Lab a communication to this effect, within the terms indicated, to the following email address info@malialab.it, or use the appropriate form on the Site in contact field. In case of withdrawal, the Customer must return the products to our warehouse within 14 (fourteen) days of withdrawal, to the following address:

The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:

the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, complements, etc...); for withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts ( including packaging and any documentation and accessory equipment: labels, tags, seals, etc...); shipping, until receipt is certified in the warehouse indicated by Malia Lab, is under the complete responsibility of the customer; in the event of damage to the goods during transport, Malia Lab will notify the Customer, to allow him to promptly file a complaint against the courier he has chosen and obtain the relevant refund; the product will then be made available to the Customer, simultaneously canceling the withdrawal request; Malia Lab will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment. Malia Lab will refund the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, through a cancellation procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. Malia Lab may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back, if earlier. In any case, the Customer will lose the right of withdrawal in cases where Malia Lab ascertains that: the returned product and/or its accessories, and/or its packaging are not intact; the product is missing its external packaging and/or the original internal packaging; the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.). the product is missing the disposable seal. In the event of forfeiture of the right of withdrawal, Malia Lab will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.

Art. 6 – Guarantees

All products sold by Malia Lab are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of the Legislative Decree. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document. The warranty for defects of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and as provided in the use and washing instructions present in and/or with the product. In the event that, for any reason, Malia Lab is unable to return a product under warranty to the Customer (restored or replaced), or if the repair or replacement is excessively expensive, also due to the value of the product, Malia Lab will be able to proceed with an appropriate reduction of the price paid, i.e. with the refund of the entire amount paid with termination of the contract. In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

Art. 8 – Privacy

The personal data collected when placing the Order will be processed by Malia Lab for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

Art. 9 – Applicable law

The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent to resolve the related disputes.

Art. 10 – Copyright

Trademarks, logos and other distinctive signs present on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited. Art. 11 – Agreement
